You can file for a California Default Judgment Request when you file for divorce and your spouse does not respond. You file for a California Default Judgment Request by completing all forms necessary for a court to grant you a dissolution of marriage (divorce). Your spouse goes into default if they do not respond which makes you eligible for the court to grant the divorce.
Upon filing a divorce petition, you must serve a copy of the petition along with the summons to your spouse. Your spouse then has 30 days to respond to the petition. If your spouse does not respond within 30 days, you can apply for a default divorce.
